Art. 32. Na hipótese de o chamamento público envolver trecho ferroviário ocioso ou em processo de devolução ou desativação e não resultar na celebração de contrato de adesão, o Ministério da Infraestrutura avaliará as alternativas para a destinação do trecho ferroviário, inclusive a desativação, considerados:
I - o interesse social do serviço de transporte ferroviário; e
II - o interesse público de preservação da vocação logística.
