Artigo 41

Art. 41. O militar da reserva de 2ª classe ou da reserva de 3ª classe poderá ter o seu serviço ativo interrompido pelos seguintes motivos:
I - anulação da incorporação;
II - desincorporação;
III - deserção; ou
IV - extravio.
§ 1º A interrupção do serviço ativo por deserção ou por extravio ocorrerá conforme o estabelecido na Lei nº 6.880, de 1980.
§ 2º Além das hipóteses previstas no caput, o Aspirante a Oficial da reserva de 2ª classe incorporado poderá ser excluído ex officio a bem da disciplina de acordo com o estabelecido na Lei nº 6.880, de 1980, na Lei nº 4.375, de 1964, e no Decreto nº 76.322, de 1975.
